All items sell AS-IS, WHERE-IS.  Preview is available daily during daylight hours, and is strongly encouraged. There is no warranty expressed or implied on auction items. Buyer's are responsible for reading descriptions, examining pictures and inspecting items in person to their satisfaction before bidding. All bids are a legally binding contract, and all sales are final.

We make every attempt to put accurate information, such as year models, hours, mileage, etc. in the auction listing, HOWEVER, the auction catalog is not the Bible. Buyer's are responsible for verifying information on their own prior to bidding. We do not guarantee year models, mileage, hours, etc. We do not have X-ray vision and cannot predict a mechanical failure of machinery. If an issue is noticed during listing, Witcher Auctions makes every reasonable effort to disclose it. If an issue arises at any point after the item is declared sold, it is the buyer's responsibility... even if during loadout.

Buyer understands and expressly agrees any statements or representations concerning the value, condition or quality, useful life, or use of the item made by the owner or Auction Company to the buyer is simply opinion, not statements of fact, and do not create any promise, warranty, or guarantee for the buyer's benefit. It is the buyer's sole responsibility to physically inspect items prior to bidding. It is not the consignor/seller's responsibility to physically inspect items for buyers. 

Any loading assistance offered is a courtesy. Witcher Auctions will make every effort to assist with loading during the listed loadout dates/times if available. Witcher Auctions is not responsible for any injury or damage during loadout. Any buyer or buyer's representative that uses Witcher Auctions' machinery to load themselves, does so at their own risk. Neither Witcher Auctions, it's sellers or any property owner is responsible for security, damage or personal injury before, during or after an auction event. Buyers and their agents agree to participate at their own risk. 

Buyer shall be responsible for any and all taxes, shipping costs, and shipping or delivery arrangements. Buyer is responsible for abiding by loadout assistance dates/times as well as item removal deadlines.

A credit card is required to register for online bidding. Nothing will be charged to your card UNLESS you fail to pay or make payment arrangements within 48 hours of the auction close. If an invoice remains unpaid after Monday, February 17 at 5pm, Witcher Auctions reserves the right to run the card on file for up to the full amount of all invoices totaling $2,500 or less and for up to a $2,500 deposit all other invoices.

Payment: Payment can be made at our Wynne office on Friday, March 14, and Monday March 17, from 8-5, by approved check, cash, cashiers check, wire transfer or credit card. PAYMENT IS DUE BY 5PM ON Monday, March 17. We do not accept payment by mail. The mail service is horribly slow and unreliable. Do not mail payment.  All checks are subject to verification with your bank before any items will be released.

No items will be removed from sale site without receipt of payment in full. Bids placed at this auction are  legally binding. All sales are final. Witcher Auctions reserves the right to hold any items from removal until full payment is verified.

- Special Conditions for Writing Checks:

      1) We must be able to verify funds on ALL checks prior to releasing items, most of the time this is a simple phone call to a bank. Please note that even with a bank letter of funds we will still need to call your banking institution to verify. Some banks will not verify funds in which case we will not be able to release your items to you immediately.

     2) In the event you intend to make payment by check please note that if we can't get a hold of your bank we will not be able to release your items to you immediately.

     3) In the event that you want to write a check and we are unable to verify funds we will accept the check. Once the check has cleared, we will e-mail you a paid invoice at which time you will be able to pickup you items.

ITEM REMOVAL: Load out ASSISTANCE will be available for pickup on Friday, March 14, from 9am - 4pm , and Saturday, March 15 from 9am - 4pm, then by appointment only thru Tuesday, March 25. A telehandler will be onsite through Thursday, March 20. After that item removal will be 100% the buyers responsibility. All items MUST be removed within 21 days after the auction close after that all items will be considered abandoned and will become property of Witcher Auctions with no recourse to the buyer unless prior arrangements are made.

TAXES/FEES

  • No Sales Tax
  • Flat 3% buyers premium on all items
  • 5% processing fee for all credit card purchases.

Amendments to auction catalog, descriptions or terms of sale day thru auction day, take precedence over all advertisements.

By registering for this auction, bidder acknowledges that they are fully responsible for any personal injury or property damage caused by bidder, bidders guests or agents. Bidder agrees to hold Witcher auctions harmless for any personal injury to himself or his agents and any property damage incurred on auction premises. Bidder releases Witcher Auctions and the seller from any and all liability connected with the loading, removal and transportation of purchases and all future uses for the goods purchased herewith.

Witcher Auctions LLC and it's employees act as agents of sellers. All auctions are with reserve unless specifically stated otherwise. Reserves, if any, are not necessarily disclosed. Additionally, bids may be placed at some auctions by the seller, an employee of the seller, or an agent on the seller's behalf up to the reserve.

By registering for this and other auctions, buyers, buyer's agents and other related parties acknowledge that the provisions of this agreement ( the auction terms) are governed by the State of Arkansas, without regard to conflict of laws from any other jurisdiction(s). Further, for the purposes of any action, lawsuit or other proceedings brought to enforce this Agreement, relating to it, or arising from it, the parties hereby submit to and consent to the sole and exclusive jurisdiction of the courts of Cross County, Arkansas, or the federal courts for the Eastern District of Arkansas, the venue in which this agreement is executed, and no other courts.
